Der von W. SELB (S.) und H. KAUFHOLD (K.) unter dem Titel „Das Syrisch-Römische Rechtsbuch“ (SRRB) edierte Text hat seit dem Ende des 17. Jahrhunderts zunächst in Form von kleinen Fragmenten in verschiedenen orientalischen Sprachen Spuren in der europäischen rechtsgeschichtlichen Forschung hinterlassen. Erst mit der Entdeckung einer syrischen Handschrift im Britischen Museum durch J. P. N. Land 1858 ist das Werk in einem wesentlichen Textzeugen bekannt und seitdem durch weitere Funde ergänzt, ins Lateinische und moderne Sprachen übersetzt und juristisch kommentiert (...) worden. Dennoch hat es bislang keine auf allen (syrischen) Handschriften beruhende kritische Edition erfahren. Die Autoren machen dies im ersten Kapitel (Bd.1, 27–42) verständlich, indem sie die Irrungen und Wirrungen der Wissenschaftsgeschichte des Textes darlegen. In diesem ersten Kapitel werden die Grundfragen, welche sich mit dem Text und seinem Verständnis verbinden, in offener und klarer Sprache formuliert. Das SRRB ist demnach eine einheitliche Sammlung von Erklärungen zu juristischen Texten zumeist normativen Charakters (Kaiserinstitutionen, leges) oder seltener von Juristenschriften (z. B. Paulussentenzen) aus verschiedenen Zeiten, die als „interpretatio“ um das Jahr 474 n. Chr. in griechischer Sprache entstanden ist (I, 46). Diese Erkenntnis, die S. im Kern schon in seiner Habilitationsschrift thesenhaft formuliert hat, wird durch die gegenwärtige Schrift erhärtet. Sie bildet die Grundlage für jede weitere Beschäftigung mit der Quelle. Richtungsweisend sind ebenfalls die nunmehr angestellten Überlegungen zum Verfasser des SRRB. In einer Handschrift (R III) wird ein Ambrosius confessor als Autor benannt. Diese Notiz deutete die Forschung bislang als Hinweis auf den Kirchenvater Ambrosius von Mailand, der freilich als Autor eines juristischen Werkes mit prononciert östlicher Verbreitung schwerlich in Frage kommt. Dennoch haben die Autoren die handschriftliche Notiz nicht als völlig aus der Luft gegriffen betrachtet. (shrink)

The literature on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises concerns that these technologies may affect personality, mood, and behavior. We conducted semi-structured interviews with researchers (n = 23) involved in developing next-generation DBS systems, exploring their perspectives on ethics and policy topics including whether DBS/aDBS can cause such changes. The majority of researchers reported being aware of personality, mood, or behavioral (PMB) changes in recipients of DBS/aDBS. Researchers offered varying estimates of the frequency of PMB changes. A (...) smaller majority reported changes in personality specifically. Some expressed reservations about the scientific status of the term ‘personality,’ while others used it freely. Most researchers discussed negative PMB changes, but a majority said that DBS/aDBS can also result in positive changes. Several researchers viewed positive PMB changes as part of the therapeutic goal in psychiatric applications of DBS/aDBS. Finally, several discussed potential causes of PMB changes other than the device itself. (shrink)

Jones (1990) described ten workplace behaviors of a dubious ethical nature and determined that the hierarchical position adopted by respondents influenced the perceived acceptability of these behaviors. This measure seems promising, and therefore the purpose of this investigation is two-fold: (1) to explore further the psychometric properties of these ten items; and (2) to examine the role of individual difference variables as correlates of perceived acceptability. In two samples of working people, the Jones items were found to be internally consistent, (...) not obviously subject to range restriction, modestly related to social desirability, largely orthogonal to age and managerial status, but clearly linked with Machiavellianism. The nature of the linkage between perceived acceptability and both sex and the Protestant work ethic differed across the two studies, which underscores the need for future research. Two additional variables worth investigating in such research may be locus of control and equity sensitivity. (shrink)

Hugely facilitated by the Internet, plagiarism by students threatens educational quality and professional ethics worldwide. Plagiarism reduces learning and is correlated with increased fraud and inefficiency on the job, thus lessening competitiveness and hampering development.In this context, the present research examines 48 licenciatura theses and 102 masters theses from five of Mozambique’s largest universities. Of the 150 theses, 75% contained significant plagiarism (>100 word equivalents) and 39%, very much (>500 word equivalents). Significant plagiarism was detected in both licenciatura and masters (...) theses. By using both Turnitin and Urkund to identify potentially plagiarized passages, professionally verifying whether those passages contain plagiarism, and, if confirmed, counting the words involved, the study presents a new method for classifying the quantity and significance of plagiarism. The use of two text-similarity-recognition programs also improved the rate of detection and, in some theses, significantly increased the classification of the gravity of the plagiarism encountered.Based on a broad review of the literature, the article argues that, to combat wide-scale plagiarism, academic institutions need to cultivate a consensus among faculty and students about the definition and types of plagiarism, the appropriate penalties, and the paramount professional and economic need to nurture professional ethics. However, to achieve even partial success requires significant involvement by administrators, faculty, students and student leaders guided by a holistic strategy using technological, pedagogical, administrative and legal components to prevent and detect plagiarism and then reeducate or discipline students caught plagiarizing. This study examined some ethical implications of two different individual competitive orientations. Winning is crucially important in hypercompetitiveness , whereas a personal development (PD) perspective considers competition as a means to self-discovery and self-improvement. In a sample of 263 senior-level undergraduate business students, survey results suggested that hypercompetitiveness was generally associated with “poor ethics” and PD competitiveness was linked with “high ethics”. For example, hypercompetitive individuals generally saw nothing wrong with self-interested gain at the expense of others, but PD competitors (...) viewed such activities as largely inappropriate. Hypercompetitive people also tended to be highly Machiavellian but not ethically idealistic. In contrast, PD competitors tended to be ethically idealistic but not Machiavellian. Managers that are interested in both high ethics and high functioning work groups may wish to consider the potential importance of attempting to channel hypercompetitive tendencies into PD directions. The mere presence of irrelevant external stimuli results in interference with the fidelity of details retrieved from long-term memory (LTM). Recent studies suggest that distractibility during LTM retrieval occurs when the focus of resource-limited, top-down mechanisms that guide the selection of relevant mnemonic details is disrupted by representations of external distractors. We review findings from four studies that reveal distractibility during episodic retrieval. The approach cued participants to recall previously studied visual details when their eyes were closed, or were open (...) and irrelevant visual information was present. The results showed a negative impact of the distractors on the fidelity of details retrieved from LTM. An fMRI experiment using the same paradigm replicated the behavioral results and found that diminished episodic memory was associated with the disruption of functional connectivity in whole-brain networks. Specifically, network connectivity supported recollection of details based on visual imagery when eyes were closed, but connectivity declined in the presence of visual distractors. Another experiment using auditory distractors found equivalent effects for auditory and visual distraction during cued recall, suggesting that the negative impact of distractibility is a domain-general phenomenon in LTM. Comparisons between older and younger adults revealed an aging-related increase in the negative impact of distractibility on retrieval of LTM. Finally, a new study that compared categorization abilities between younger and older adults suggests a cause underlying age-related decline of visual details in LTM. The sum of our findings suggests that cognitive control resources, although limited, have the capability to resolve interference from distractors during tasks of moderate effort, but these resources are overwhelmed when additional processes associated with episodic retrieval, or categorization of complex prototypes, are required. Knowledge about ethical judgments has not advanced appreciably after decades of research. Such research, however, has rarely addressed the possible importance of the content of such judgments; that is, the material appearing in the brief vignettes or scenarios on which survey respondents base their evaluations. Indeed, this content has seemed an afterthought in most investigations. This paper closely examined the vast array of vignettes that have appeared in relevant research in an effort to reduce this proliferation to a more concise (...) set of overarching vignette themes. Six generic themes emerged from this process, labeled here as Dilemma, Classic, Conspiracy, Sophie’s Choice, Runaway Trolley, and Whistle Blowing. Each of these themes is characterized by a unique combination of four key factors that include the extent of protagonist personal benefit from relevant vignette activities and victim salience in vignette descriptions. Theme identification enabled inherent ambiguities in vignettes that threaten construct validity to come into sharp focus, provided clues regarding appropriate vignette construction, and may help to make sense of patterns of empirical findings that heretofore have seemed difficult to explain. The construct of cognitive moral development seemingly has powerful practical relevance in many areas of life. Nonetheless, moral reasoning seems of marginal relevance at best in the context of business ethics. Simply put, moral reasoning measurement indices are often only weakly related to many other apparently pertinent variables, and such findings cast doubt upon the construct validity of cognitive moral development. Many such unexpectedly weak relationships, however, may stem from two largely unrecognized methodological artifacts. The first artifact is an almost (...) total reliance on the P index of the Defining Issues Test (DIT) designed to assess moral development even when this index may be inappropriate in a particular context. A second artifact that seems particularly salient in the context of attitudes toward authority involves a not always appropriate reliance on samples that include respondents whose moral reasoning is uncoupled from their action choices. These artifacts may restrict the amount of variance explained in observed relationships, and thus constrain the potential for moral reasoning to understand and explain behavior and attitudes relevant in the context of business ethics. Researchers are urged to use DIT D scores (in addition to P scores) in specific situations, and to examine relationships among high DIT U scorers whose moral reasoning is tightly coupled with their action choices. The application of these guidelines may have profound implications for advancing our fundamental understanding of moral reasoning, and of increasing its relevance to business ethics. (shrink)

Hippocrates is a towering figure in Greek medicine. Dubbed the 'father of medicine', he has inspired generations of physicians over millennia in both the East and West. Despite this, little is known about him, and scholars have long debated his relationship to the works attributed to him in the so-called 'Hippocratic Corpus', although it is undisputed that many of the works within it represent milestones in the development of Western medicine. In this Companion, an international team of authors introduces major (...) themes in Hippocratic studies, ranging from textual criticism and the 'Hippocratic question' to problems such as aetiology, physiology and nosology. Emphasis is given to the afterlife of Hippocrates from Late Antiquity to the modern period. Hippocrates had as much relevance in the fifth-century BC Greek world as in the medieval Islamic world, and he remains with us today in both medical and non-medical contexts. (shrink)

The harsh consequences of the American plant closing epidemic in recent years on workers, their families, and their communities, has raised widespread ethical and moral concerns. In the early 1970s, a diverse group of academics, social activists, public policy analysts, and special interest organizations developed a number of legislative proposals designed to restrict closings by law. The proposals encountered many formidable obstacles in an increasingly hostile free-market environment. The business community was itself moved to assume some of the burdens precipitated (...) by closures either unilaterally or through collective bargaining. At the same time, powerful business interests tenaciously fought the enactment of mandatory closing restrictions into law. Nevertheless, through a prolonged and tortuous odyssey, the requirements of advanced notice and worker severence pay have now begun to root in law. Their success stands as evidence of a continuing American public policy receptivity to ethics-driven concerns. (shrink)

Investigations into ethical judgments generally seem fuzzy as to the relevant research domain. We first attempted to clarify the construct and determine domain parameters. This attempt required addressing difficulties associated with pinpointing relevant literature, most notably the varied nomenclature used to refer to ethical judgments (individual evaluations of actions’ ethicality). Given this variation in construct nomenclature and the difficulties it presented in identifying pertinent focal studies, we elected to focus on research that cited papers featuring prominent and often-used measures of (...) ethical judgments (primarily, but not exclusively, the Multidimensional Ethics Scale). Our review of these studies indicated a preponderance of inferences and conclusions unwarranted by empirical evidence (likely attributable at least partly to inconsistent nomenclature). Moreover, ethical judgments related consistently to few respondent characteristics or any other variables, emergent relationships may not always be especially meaningful, and much research seems inclined to repetition of already verified findings. Although we concluded that knowledge about ethical judgments seems not to have advanced appreciably after decades of investigation, we suggested a possible path forward that focuses on the content of what is actually being judged as reflected in the myriad of vignettes used in the literature to elicit judgments. To understand the intracellular mechanisms that control exocytosis it is necessary to have access to the cell interior. This is achieved by plasma membrane permeabilisation or by application of patch‐pipettes. These conditions permit control over the cytosol composition and also allow leakage of soluble factors that may have roles in the exocytotic mechanism. Different permeabilisation methods allow different extents of leakage and therefore provide complementary data. The exocytotic machinery itself remains intact and can be activated by providing Ca2+ and/or a (...) guanine nucleotide. In some cells there is evidence for the participation of two guanine nucleotide‐binding proteins (Gp and GE), as well as a Ca2+ ‐binding protein. In others Ca2+ is the only requirement. In a number of cell types, ATP is not required for the late steps in the secretory pathway. (shrink)

The production of manuscripts can be an indication for the scientific, linguistic or medical interests of a community. In this paper the author argues that Parisinus Graecus 2293, a bilingual Greek-Arabic manuscript, containing parts of the first three books of Paul of Aegina's medical encyclopaedia, was produced in Sicily or Southern Italy, probably in Palermo during the reign of the Hohenstaufen. It is thus a testimony to the fervent scientific and medical interest of the Swabian court which promoted cultural exchange (...) between the East and the West. The purpose of the manuscript was not so much to help medical practice but rather to further bilingualism by giving the reader a tool with which he could improve his knowledge of either language. This essay places some conceptual pressure on the model of a “learning process” in Jürgen Habermas’s Auch eine Geschichte der Philosophie, and it asks whether this model introduces a subtle asymmetry into the relationship between religion and secular philosophy. Such an asymmetry would seem to obtain insofar as religious tradition is granted a privileged or unique status as the source of normative insights that are then available for rational scrutiny and translation into secular life. The essay also draws a comparison (...) between Lessing and Habermas: Lessing, like Habermas, saw revelation as a source of instruction for humanity, and affirmed that religion could thereby play a role in the Erziehung des Menschengeschlechts. But Lessing was careful to say that no valuable normative contents are found in religion that could not also be derived by secular reason alone. Habermas’s genealogy of post-metaphysical thinking does not seem to confirm Lessing’s idea; instead, it appears to confirm an asymmetry in the relation between religion and secular philosophy. We now (...) know as much about the history of this corpus as we are likely to discover without the introduction of new evidence, and scholarly attention might logically be expected to return to the interpretation and criticism of these poems. Transmitted for the most part in the socalled Palatine Anthology and filtered through the agency of anthologists ancient and medieval, the epigrams of the ancient practitioners of this minor genre have tended to be studied individually, [End Page 628] like gemstones dislodged from their original settings. The luster of each piece may be easily admired, but what has been lost is the color and clarity that is imparted by the contrast with its neighbors. The ambitious task that Kathryn Gutzwiller has set herself in this closely argued and learned book is no less than to recover from the collecta membra of the Palatine Anthology the contours of the epigram books of nine poets from the early Hellenistic period to Meleager in the first century B.C.E.The opening chapter provides an introduction, which, taken together with the following chapter ("Hellenistic Epigram Books"), lays the foundation for the remainder of the work and establishes its basic premise, that all the Hellenistic epigrammatists composed their work for "publication" in carefully constructed books, arranged on principles which Gutzwiller can recover. This is the basis for what she terms "a new interpretative strategy" in the criticism of Hellenistic epigrams, "to read them as if"—her emphasis—"we knew their place in historical collections" (7). The remainder of the book is occupied by her reconstructions of the epigram books of Anyte, Nossis, Leonidas of Tarentum, Asclepiades, Posidippus, Hedylus, Callimachus, Antipater of Sidon, and Meleager. Readers who are convinced by her arguments in these opening chapters will be swept along by her hypothetical arrangements, which she supports with close readings of individual poems set in their new contexts. Others, myself included, will remain suspicious of the solidity of the foundations of this edifice, while still finding much to admire in her sophisticated interpretations of individual poems.Much of Gutzwiller's theoretical underpinning depends upon rather strict adherence to the orthodox view of what she characterizes as the "Callimachean aesthetic preference for the miniature, the intricate, and the fragmented" (4). The Hellenistic epigram books that she posits correspond neatly with Callimachean aesthetics so described. She rejects out of hand Cameron's arguments for the social role of epigram in a sympotic setting, in favor of the bookish background described by (e.g.) Peter Bing. The hypothesis of a neat and well– ordered world of Hellenistic poetry books, as outlined by some modern scholars, is not undisputed, but readers will not hear much about that here. Gutzwiller sweeps aside skeptical challenges to this picture, and the possibility, for example, that Callimachus produced a collected edition of his poetry, advanced only as a hypothesis by Rudolf Pfeiffer, is here (19) represented as "the probability... that Callimachus published his complete oeuvre, ordered and divided into books." Her summary of the papyrus evidence paints a far more stable picture of the situation of books in the manuscript culture of the Hellenistic world than the evidence safely allows. For Gutzwiller, any references to the of a poet "indicate an authorially compiled epigram book" (20). This naïve extension of Pfeiffer's theory of the composition of a "Collected Works" of Callimachus, and unswerving allegiance to the communis opinio of Callimachean aesthetics, are recurring themes in Gutzwiller's reconstructions of ancient epigram books. DNA topoisomerase II (topo II) is involved in chromosome structure and function, although its exact location and role in mitosis are somewhat controversial. This is due in part to the varied reports of its localization on mitotic chromosomes, which has been described at different times as uniformly distributed, axial on the chromosome arms and predominantly centromeric. These disparate results are probably due to several factors, including use of different preparation and fixation techniques, species differences and changes in distribution during the (...) cell cycle. Recently, several papers have re‐investigated the distribution of topo II on chromosomes as a function of cell cycle and species(1–3). The new studies suggest that Topo II has a dynamic pattern of distribution on the chromosomes, in general becoming axial as chromosomes condense during prophase and then concentrating at centromeres during metaphase. These experiments suggest a novel role for topo II in centromere structure and function. (shrink)
